Freedom of Information and Confidentiality

Leeds City Council/Digital Enterprise will respect the confidentiality of applicants where possible and will not share application information, without consent, with any third party not directly involved in the application process. However, Leeds City Council/Digital Enterprise is subject to the Freedom of Information Act 2000 (FOIA) and in certain circumstances is required to release information that it holds, if specifically requested to do so or in line with the Transparency Code. Leeds City Council/Digital Enterprise, in its absolute discretion, may decide to withhold the disclosure of certain information due to a statutory FOIA exemption in certain circumstances (though it will seek to consult with you beforehand if possible).

Please indicate if there is information that you have supplied as part of your application that you believe should not be disclosed as:

i) it is provided by you to us in confidence (and is thus subject to the exemption from disclosure in s. 41 FOIA); and/or
ii) it would be likely to prejudice the commercial interests of any party if released (and is thus subject to the exemption from disclosure in s. 43(2) FOIA)

However, a final decision as to whether or not to disclose information under the FOIA rests with Leeds City Council/Digital Enterprise.

Leeds City Council/Digital Enterprise is subject to the Transparency Code and, if your application is successful, will publish your company name and amount of grant awarded on its website.

Leeds City Council/Digital Enterprise will use any personal data within this application solely in connection with the evaluation and appraisal of the application and will comply with its obligations under the Data Protection Act 1998.

Privacy Statement

1. Leeds City Council/Digital Enterprise takes its obligations under the Data Protection Act very seriously. The information you provide on your application form will be subject to rigorous measures and procedures to make sure that it cannot be seen, accessed or disclosed to anyone who should not see it.

2. Any personal information you provide on this form will only be used to administer your application for a Digital Growth Voucher. The Digital Growth Voucher scheme forms part of the Digital Enterprise project operated by the Department for Communities and Local Government and Leeds City Council. The Department for Communities and Local Government is the owner (the ‘Data Controller’) of any personal information you provide. Leeds City Council (and its sub-contractors) are considered to be ‘data processors’ of this information.

3. Your details will be held in accordance with the Data Protection Act 1998. Under the Data Protection Act 1998, we may share information with other people and organisations where we are required by law to do so, or with appropriate justification under the Act. This includes where disclosure is necessary to enable the council or another organisation to exercise its statutory functions (for example, the Police).

4. Leeds City Council use Evolutive (a cloud based customer relationship management system) to administer your Digital Growth Voucher application. Evolutive and will hold all the data that they process on the Council’s behalf in accordance with the Data Protection Act 1998 and will not share this with any third parties.

5. The Digital Knowledge Exchange scheme (Workshops/Masterclasses and mentoring support) will be delivered by BE Group, who is contracted to the Council. As such, some personal information you provide to the Council will be provided to BE Group to enable them to facilitate these workshops.

6. All information provided by the Council to BE Group will be held in accordance with the Data Protection Act 1998 and will not be shared with any third parties. BE Group will also provide attendance data back to the Council regarding these workshops.

7. If your application is successful, all the personal data you provide will be held until 2033, in accordance with the requirements of the Department of Communities and Local Government (the data controller).
